These Terms of Service (“Terms”) govern your use of the ATM Kids mobile application and related services (the “App”), operated by James Simoes d/b/a POCO (“we,” “us,” or “our”).
By creating a parent profile, checking the agreement box during setup, or purchasing access to the App, you agree to these Terms. If you do not agree, do not use the App.
1. Who may use ATM Kids
ATM Kids is designed for families. A parent or legal guardian (“Parent”) must set up and manage the App. By using the App, you represent that you are at least 18 years old and have authority to provide information about your family and to accept these Terms on behalf of any children whose information you enter.
Children should use the App only under Parent supervision and with a Parent PIN or device security controls in place.
2. What ATM Kids provides
ATM Kids is a local-first family app for chores, rewards, wish lists, and simple money tracking. The App helps Parents manage tasks and allowances and helps children track earnings, spending, and savings goals.
ATM Kids is not a bank, payment processor, or financial advisor. Balances and transactions in the App are for family record-keeping only. Real money transfers happen outside the App, under your own supervision.
3. Your data stays on your device
ATM Kids is built to keep your family’s information on your device.
- Child names, chores, balances, wish lists, transaction history, optional profile photos, backups, and most parent settings are stored locally on your phone or tablet.
- We do not operate a cloud account system for your family data.
- You are responsible for creating and safeguarding encrypted backups if you want to move to a new device or recover from data loss.
If you delete the App or erase data on your device without a backup, that information may be permanently lost. We cannot recover it for you.
4. Parent information and communications
During setup, we ask for a Parent name and email address. We use this information to:
- Provide customer support
- Send important service-related messages
- Send product updates and announcements, but only if you opt in
You may choose whether to receive marketing or product-update emails during setup. You can contact us at any time to opt out of non-essential emails.
5. Free trial and lifetime purchase
ATM Kids may offer a free trial period (currently 7 days) so you can try the App before purchasing.
After the trial ends, continued use requires a one-time lifetime purchase through Apple’s In-App Purchase system. There is no monthly subscription.
All purchases are processed by Apple. Pricing, billing, refunds, and purchase restoration are handled under Apple’s terms and policies. We do not receive your payment card details.
If you change devices or reinstall the App, you may need to use Apple’s “Restore Purchase” option to regain access.
6. Acceptable use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to reverse engineer, interfere with, or misuse the App
- Use the App in a way that harms children or violates their rights
- Misrepresent your identity or authority over a child
We may suspend or discontinue the App if we reasonably believe these Terms have been violated.
7. Third-party links and services
The App may include links to third-party websites or services, including Amazon product search links for Parents. Those services are operated by third parties and are subject to their own terms and privacy policies. We are not responsible for third-party sites or services.
Some support and signup messages are delivered through third-party form services that forward messages to us. Those providers process only the information you or the App submits for that purpose.
8. Intellectual property
The App, including its design, branding, and software, is owned by us or our licensors. These Terms do not grant you any rights to our trademarks or content except the limited right to use the App as intended.
9. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that the App will be uninterrupted, error-free, or free from data loss. You are responsible for maintaining backups and securing your device.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will post the updated Terms at this URL and update the effective date above. Continued use of the App after changes become effective means you accept the revised Terms.
12. Governing law
These Terms are governed by the laws of Massachusetts, USA, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your location apply.
